British, with a home in Spain?

Since Brexit, UK citizens count as non-EU visitors: 90 days in any 180, however long you have owned the house. To spend more of the year here you need a residence permit, and the right one depends on whether you still work in the UK.

Before the purchase closes, the bank will want the paper trail.

Spanish banks and notaries must check where the money for a purchase comes from. Jimena Sastre, our managing partner, chairs the Spain chapter of ACFCS, the association of financial crime specialists. We put the file together before anyone asks for it.

FAQ

Before you buy in Spain.

Do I need a lawyer to buy property in Spain?

It isn’t compulsory. The notary makes sure the deed is valid, but doesn’t act for you. Checking the planning status, unpaid community fees and what you are agreeing to in the deposit contract is up to the buyer, and that is the work we do.

How long can I stay in Spain without a visa?

Visitors from the US, the UK, Canada or Australia can stay up to 90 days in any 180-day period. Owning a home here doesn’t change that: to stay longer you need a residence permit.

What replaced the Golden Visa?

Nothing works quite the same way. People who won’t work in Spain usually apply for non-lucrative residence; people who work remotely, for the digital nomad visa.

Do I pay tax in Spain on a holiday home I don’t rent out?

Yes. Non-residents pay non-resident income tax on the property every year even when it sits empty, plus IBI, the local property tax. If you rent it out, the rent is taxed separately.
